2) Eligibility

• You must be at least 13 years old to use the Service.

• To place an order, you must be at least 18 years old (or the age of majority where you live) and able to enter a binding contract.

3) Account Registration & Security

You may need to create an account to access certain features. You agree to:

• Provide accurate and current information.

• Maintain the security of your login credentials.

• Notify us promptly if you suspect unauthorized access.

You are responsible for activity under your account.

4) Orders, Menu Information & Availability

• Menu items, prices, availability, and descriptions may change at any time.

• Photos are for presentation and may not exactly match the final product.

• If an item is unavailable, we may contact you for a substitution, remove the item and adjust pricing, or cancel and refund the affected item.

5) Food Allergies & Dietary Notices

We cannot guarantee items are allergen-free. Our kitchen may handle common allergens, including (but not limited to) dairy, eggs, soy, wheat/gluten, peanuts/tree nuts, and shellfish. You are responsible for reviewing menu information and contacting us before ordering if you have severe allergies or dietary restrictions: chillwings@icloud.com.

6) Payments

Payments may be processed by third-party payment providers. By submitting payment information, you represent you are authorized to use that method. We may cancel orders or suspend access if we reasonably suspect fraud, misuse, or repeated chargebacks.

7) Pickup Orders

Chill Wings currently provides pickup ordering unless otherwise stated in the app.

Pickup Requirements:

• Pickup availability is based on the app’s posted Hours of Operation.

• Bring your name and order number to confirm pickup.

• You are responsible for picking up promptly. Food quality/temperature may be affected by late pickup, and we are not responsible for changes due to late arrival.

8) Cancellations, Refunds & Order Issues

Because food is prepared quickly, orders may not be cancellable after confirmation.

Refund/Issue Reporting Window: You must contact us within 1 hour of pickup (or your scheduled pickup time) for help.

We may offer a refund or replacement when appropriate, including for missing items, incorrect items, or verified safety/quality concerns.

To request help, email chillwings@icloud.com within the 1-hour window and include: (1) order number, (2) description of the issue, and (3) photos (if applicable).

Approved refunds are issued back to the original payment method. Processing time depends on your bank/provider.

9) Promotions, Coupons & Rewards (If Offered)

Promotions may have limits, exclusions, and expiration dates; they are not redeemable for cash. We may modify or discontinue promotions at any time. Suspected abuse may result in cancellation and suspension.

10) User Content (Reviews, Comments, Photos)

If you submit content through the Service, you grant Chill Wings a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content for operating and promoting the Service. You agree your content will not be illegal, misleading, abusive, or infringe others’ rights. We may remove content at our discretion.

11) Intellectual Property

All app content (including logos, branding, design, text, and software) is owned by Chill Wings/Beyond The Limits LLC or its licensors and is protected by law. You may not use our branding without written permission.

12) Acceptable Use

You agree not to:

• Violate any laws while using the Service.

• Attempt to access systems without authorization.

• Disrupt the Service (including via bots, scraping, or reverse engineering).

• Submit fraudulent orders or misuse promotions.

• Harass or threaten others.

We may suspend or terminate access for violations.

13) Third-Party Services

The Service may integrate third-party services (e.g., payment processing, analytics). Third-party services are governed by their own terms and privacy practices.

14) Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

15) Limitation of Liability

To the maximum extent permitted by law, Chill Wings and Beyond The Limits LLC will not be liable for indirect, incidental, special, consequential, or punitive damages. Total liability for any claim related to the Service will not exceed $50. Some jurisdictions do not allow certain limitations; in those cases, the limitation applies only to the extent permitted by law.

16) Indemnification

You agree to indemnify and hold harmless Chill Wings and Beyond The Limits LLC from claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, your content, or your violation of these Terms.

17) Text Messages (SMS/MMS) & Consent

If you provide your phone number and opt in (where applicable), you agree we may send SMS/MMS messages for:

• Order confirmations and pickup updates (transactional).

• Customer support responses.

• Promotions/specials only if you opt in to marketing.

Message Frequency: Varies. Message & Data Rates: May apply.

Opt-Out: Reply STOP to unsubscribe (you may receive one final confirmation message).

Help: Reply HELP or email chillwings@icloud.com.

Carrier Notice: Carriers are not liable for delayed/undelivered messages.

Consent Not Required to Purchase: Marketing consent is not a condition of purchase.

18) Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date will change. Continued use after updates means you accept the revised Terms.

19) Governing Law & Venue

These Terms are governed by the laws of the State of South Carolina. Any disputes will be resolved in state or federal courts located in Barnwell County, South Carolina, unless otherwise required by law.
